ELIGIBILITY AND PARTICIPATION
Participants must be 18 years or older to participate. Any participation by persons under 18 is strictly prohibited. By choosing to participate in this search, you agree to indemnify and hold me harmless from any and all claims, injuries, damages, losses, or suits, including attorney fees, arising out of or in connection with the treasure hunt.
RISKS AND LIABILITY
I am not responsible for any personal injury, loss, or damage of property that may occur during the treasure hunt. I am not liable for any accidents, injuries, or losses that occur during the course of this activity. The western U.S., including rugged mountains, deserts, and wildlife, may involve hazardous conditions (e.g., steep cliffs, extreme weather, wildlife encounters). Participants assume all risks and are responsible for their safety and preparation.
PROHIBITED ACTIVITIES
The following activities are strictly prohibited:
Use of heavy equipment
Use of metal detectors where prohibited by law or regulation
Operation of drones in restricted airspace or protected areas
Commercial searching operations or services, including but not limited to guided tours, paid searching services, tour groups, organized expeditions, or any searching activity conducted for commercial gain
Searching while under the influence of alcohol, drugs, or any substances that could impair judgment or reaction time
Any reckless, illegal, or dangerous searching behavior, including but not limited to: searching at night, searching without appropriate safety equipment, searching in dangerous weather conditions, or searching without proper preparation for the environment
Commercial exploitation of the search, including but not limited to: selling maps, hints, or search-related materials; organizing paid guided searches; creating commercial products or services related to the treasure hunt without express written permission; or creating any form of media content for commercial purposes including social media monetization, documentaries, books, or other commercial media about the search
Intentional harassment or intimidation of other participants in connection with the treasure hunt, whether online (e.g., social media, forums) or offline, including but not limited to credible threats, doxxing, or deliberately spreading false information to sabotage others' participation. I do not monitor or mediate participant interactions, and participants agree to hold me harmless from any claims, disputes, or damages arising from interactions with other participants
SEARCH CONDUCT AND ENVIRONMENTAL PROTECTION
Participants must respect the environment and not litter or disturb wildlife while searching. It's important to leave the Location in the same or better condition than you found it. Participants must comply with all applicable laws and regulations, not just local ones. It's crucial to respect the rights of others and avoid trespassing on private property or violating any other laws during your search.
EMERGENCY SERVICES AND COSTS
Participants are solely responsible for any costs associated with emergency response, rescue services, medical treatment, evacuation, or other emergency services that may be required as a result of their participation in the search. This includes, but is not limited to, helicopter rescue, ambulance transport, search and rescue operations, and medical treatment costs.
MULTIPLE SEARCHERS
Each participant acknowledges that multiple parties may independently search for the abandoned property. The first person to legally obtain physical possession of the abandoned property will be considered the finder. Any disputes between searching parties are solely between those parties; I expressly disclaim any liability for inter-party conflicts, disputes, or injuries.
JURISDICTION AND LEGAL COMPLIANCE
This treasure hunt and all related disputes are governed by the laws of the State of Colorado, without regard to its conflict of laws principles. You irrevocably agree that any legal action or proceeding arising out of or relating to this treasure hunt must be brought exclusively in the federal or state courts located in Colorado, and you waive any objection to the jurisdiction or venue of such courts, including any claim based on inconvenience or forum non conveniens. This treasure hunt is void where prohibited by law.
INTERNATIONAL PARTICIPANTS
This treasure hunt originates in the United States. International participants acknowledge that their participation may be subject to additional laws and regulations in their home countries. Participants are solely responsible for compliance with all applicable laws, including but not limited to customs, import/export, currency transfer, and tax regulations in any relevant jurisdiction.
